dottypet ™ is a trade mark of 6733671 CANADA INC. For the purposes of this document, the terms “dottypet™” and “6733671 CANADA INC.”; whose registered place of business is 13 Welch Cres, Okotoks, AB, T1S 1H2, CANADA are interchangeable.

dottypet™ runs a website at http://www.dottypet.com for people who are truly dotty about their pets and want to share their funny, inspirational or heartwarming pet experiences and photographs.

This policy represents the dottypet™ Terms of Service ("TOS") in its entirety and supersedes any other policy. This policy defines the TOS all customers agree to when they register with dottypet™. You may not use the services if you do not accept the terms. dottypet™ reserves the exclusive right to revise, change or amend any portion of this policy at any time, without advance notice. Continued use of services constitutes acceptance of the current TOS as posted at http://www.dottypet.com/terms_of_service.html.

dottypet™ MAKES NO EXPRESS OR IMPLIED WARRANTIES (INCLUDING BUT NOT LIMITED TO WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE) WITH RESPECT TO THE SERVICES IT PROVIDES. Neither dottypet™ nor any one else involved in the provision of Service is liable to you or any third-party for direct or indirect damages resulting from the use, non-use of services provided herein, whether or not such damages resulted from the negligence of dottypet™, even if dottypet™ has been advised to the possibility of such damages.

Limitation of Liability 
IN NO EVENT SHALL dottypet™ BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE OR OTHER CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, LOST PROFITS AND DAMAGES RELATED TO CORRUPTION OR DELETION OF WEBSITE CONTENTS, EMAIL DATA AND OR DATABASE CONTENTS) ARISING OUT OF OR IN RELATION TO THIS AGREEMENT OR YOUR USE OR INABILITY TO USE dottypet™ 'S SERVICES (INCLUDING, BUT NOT LIMITED TO, INOPERABILITY OF dottypet™ 'S SERVERS), REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, EVEN IF dottypet™ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL dottypet™ 'S MAXIMUM LIABILITY EXCEED THE TOTAL AMOUNT PAID BY YOU TO dottypet™ FOR THE SERVICES DURING THE PRIOR TWELVE (12) MONTHS. TO THE EXTENT APPLICABLE LOCAL LAW DOES NOT ALLOW THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, dottypet™ 'S LIABILITY IS LIMITED TO THE EXTENT PERMITTED BY LAW.  

Indemnification
You agree to indemnify, defend and hold dottypet™ and its affiliates, directors, officers, employees and agents harmless from and against any liabilities, losses, damages or costs, including reasonable attorneys' fees, resulting from any third-party claim, action, dispute or demand related to your use of the Services, your violation of any of the provisions of this Agreement or from your placement or transmission of any materials or content onto dottypet™'s servers. Such liabilities may include, but are not limited to, those arising from the following: (a) infringement or misappropriation of any intellectual property rights; (b) defamation, libel, slander, obscenity, pornography, or violation of the rights of privacy or publicity; or (c) spamming, or any other offensive, harassing or illegal conduct or violation of the acceptable uses described herein or anti-spam policy; (d) any damage or destruction to dottypet™ 's equipment or to any other accountholder, which damage is caused by or otherwise results from acts or omissions by you, your representative(s) or your designees; (e) any personal injury or property damage arising out of your activities related to the Services.

Content
You understand that all information (such as written text, photographs or other images) which you may have access to as part of, or through your use of, the Services are the sole responsibility of the person from which such content originated. dottypet™ does not vouch for or warrant the accuracy, completeness or usefulness of any message or image. The messages express the views of the author of the message, not necessarily the views of dottypet™ or its directors, officers & employees. dottypet™ reserves the right (but shall have no obligation) to pre-screen, review, flag, filter, modify, refuse or remove any or all Content from any Service.

The Services may include hyperlinks to other web sites or content or resources. You acknowledge and agree that dottypet™ is not liable for any loss or damage which may be incurred by you as a result of the availability of those external sites or resources, or as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, products or other materials on, or available from, such web sites or resources.

You agree that information and files uploaded to servers will not violate any provincial, federal or foreign laws or regulations; infringe on the intellectual property rights of dottypet™ or any third party; be defamatory, slanderous or trade libelous; be threatening or harassing; be discriminatory based on gender, race, age; promote hate; include obscene or sexually oriented material; or contain viruses or other computer programming defects which result in damage to dottypet™ or any third party.

Any user who feels that posted material is objectionable is encouraged to contact us immediately at http://www.dottypet.com/contact_dottypet.html. dottypet™ has the ability to remove objectionable messages and we will make every effort to do so, within a reasonable time frame, if dottypet™ in it’s absolute discretion, determines that such removal is necessary.
dottypet™ will be the sole and final arbiter as to what constitutes a violation of this policy and reserves the right to investigate and terminate the clients subscription to the service for any such breach.

Account Security
You agree and understand that you are responsible for maintaining the confidentiality of passwords associated with any account you use to access the Services. Accordingly, you agree that you will be solely responsible to dottypet™ for all activities that occur under your account. If you become aware of any unauthorized use of your password or of your account, you agree to notify dottypet™ immediately at http://www.dottypet.com/contact_dottypet.html.

Privacy
dottypet™ values your privacy. In order for you to use the Services, dottypet™ may collect personal information from you. dottypet™ may share information with third parties only in limited circumstances; including when complying with legal process, preventing fraud or imminent harm, and ensuring the security of our network and Services.
